Electronic communications & ESIGN disclosure

This Electronic Communications & ESIGN Disclosure (“Disclosure”) applies to all communications between you (“Client,” “Applicant,” or “you”) and Mōmentum Capital Funding (“Mōmentum,” “we,” “us,” or “our”).

By submitting information through our website, application portal, or otherwise engaging in electronic communications with us, you agree to receive documents, agreements, notices, and other communications electronically.

1. Consent to Electronic Records and Signatures

You consent to receive and sign electronically:

  • Applications
  • Agreements and contracts
  • Funding documents
  • Disclosures
  • Invoices and account statements
  • Notices and amendments
  • Any other documents related to your relationship with Mōmentum

You agree that electronic signatures, whether provided through a digital signature platform, typed name, click-to-accept button, or other electronic method, are legally binding and enforceable to the same extent as handwritten signatures.

This consent is provided pursuant to the federal Electronic Signatures in Global and National Commerce Act (ESIGN Act) and applicable state laws.

2. Method of Delivery

Electronic communications may be delivered to you by:

  • Electronic signature platform
  • Website posting
  • SMS notification (if consented separately)

It is your responsibility to ensure that your contact information remains current and accurate.

3. Paper Copies

You may request a paper copy of any electronically delivered document at no charge.

  • Certain services may not be available without electronic communication capability.
  • Withdrawal does not affect the validity of documents previously delivered electronically.

5. Hardware and Software Requirements

To access and retain electronic communications, you must have:

  • A device capable of accessing the internet
  • A current web browser
  • Access to a valid email address
  • The ability to open and read PDF files
  • Adequate storage capability to retain documents

You are responsible for maintaining the equipment and software necessary to receive electronic records.

6. Updating Contact Information

You agree to promptly notify Mōmentum of any changes to your:

  • Email address
  • Phone number
  • Business address

Failure to update contact information may result in missed communications.

7. Scope of Consent

Your consent applies to:

  • The initial application process
  • Any subsequent funding agreements
  • Ongoing account communications
  • Future amendments, renewals, or extensions

This consent remains in effect unless and until withdrawn in accordance with this Disclosure.

8. Acknowledgment

By submitting your information, signing electronically, or clicking to accept terms through our website or portal, you acknowledge that:

  • You have read and understand this Disclosure.
  • You consent to conduct business electronically.
  • You are able to access and retain electronic documents.
